These Terms of Service ("Terms") are a binding agreement between you and Callmama Limited, a company incorporated in Hong Kong (Company Registration No. 77766807), registered office 8/F., China Hong Kong Tower, 8-12 Hennessy Road, Wan Chai, Hong Kong ("CallMama", "we", "us"). They govern your use of the CallMama website, mobile apps, and web portal (the "Service").
By creating an account or using the Service, you agree to these Terms, the Privacy Policy, the Acceptable Use Policy, and the Refund & Cancellation Policy. If you do not agree, do not use the Service.
1. The Service
CallMama is an international calling and messaging service. We provide virtual phone numbers, voice calling, and SMS over the internet. Features depend on your plan, your device, and the country involved. Call recording is available only in the web portal; the mobile app does not record calls.
2. Eligibility and your account
You must be at least 18 years old (or the age of majority where you live) to use the Service. You must provide accurate registration information, keep your password secure, and you are responsible for all activity on your account. Tell us promptly at support@callmama.com if you suspect unauthorised use. If your account is inactive for 12 consecutive months — meaning no calls made, no messages sent, and no login — we may notify you by email and close the account if you do not respond within 30 days. Any unspent prepaid credit at that point is handled in line with the Refund and Cancellation Policy.
3. Acceptable use
You agree to use the Service only for lawful purposes and in line with our Acceptable Use Policy, which forbids, among other things, illegal robocalls and robotexts, spam, harassment, fraud, and any calling or texting that breaks telemarketing or consumer-protection law. If you send commercial electronic messages to Canadian recipients through the Service, you must comply with Canada's Anti-Spam Legislation (CASL), including obtaining prior consent, providing your identity, and honouring unsubscribe requests within 10 business days. We may suspend or terminate accounts that breach the Acceptable Use Policy or applicable anti-spam laws.
4. Emergency calls (911 / 112 / other emergency numbers) — important
Limitations include:
- CallMama cannot connect you to emergency services (911, 112, or equivalent).
- No location data or callback number will be transmitted to emergency operators.
- Emergency calling will not work if your internet connection is down, your device is off, or your account is suspended or inactive.
By using CallMama, you acknowledge and accept these limitations and agree to maintain an alternative means of contacting emergency services at all times.
5. Plans, pricing, and credit
Prices for plans, numbers, and per-minute or per-message rates are shown in the Service before you buy. We may change prices for future billing periods. Where a price change affects a recurring charge, we will give you at least 30 days' advance notice by email or in-app notification and a chance to cancel before the new price takes effect. Prepaid credit, where offered, is used to pay for usage at the rates shown and is non-refundable except as set out in the Refund & Cancellation Policy or as required by law.
6. Automatic renewal and recurring billing
Many CallMama plans and number rentals renew automatically. By choosing a recurring plan you authorise CallMama and our payment processor, Stripe, to charge your payment method automatically at the start of each billing period until you cancel.
- The price, the billing interval (for example monthly or yearly), and the fact that the plan renews automatically until cancelled are shown to you at the point of purchase, next to the payment button.
- After you purchase, we send a confirmation that restates the renewal terms and tells you how to cancel.
- You can cancel at any time in your account settings, online or in the app, in roughly the same number of steps it took to subscribe. We do not require you to call us to cancel.
- Cancelling stops future renewals. It takes effect at the end of the current paid period unless the law gives you an earlier right.
- If we change the price or a material term of a renewing plan, we will give you advance notice and a chance to cancel before the change takes effect.
Refund eligibility, including any cooling-off rights for EU and UK consumers, is set out in the Refund & Cancellation Policy.
7. Virtual phone numbers
A virtual number is licensed to you for use while your plan is active; you do not own the number. Numbers may need to comply with the rules of the country they belong to, including identity or address verification. If you stop paying, let a number lapse, or breach these Terms, the number may be reclaimed and, once reclaimed, may not be recoverable. Number portability, where available, is governed by the rules of the relevant country.
8. Call recording
Call recording is a web-portal feature. If you enable it, you are responsible for obtaining any consent required by the laws that apply to you and to the other people on the call. Many jurisdictions require every participant to consent to being recorded. Our Call Recording Notice explains this and the tools we provide. You agree to use recording only lawfully and to indemnify CallMama against claims arising from your recordings.
9. Your content and communications
You keep all rights in the content you create, send, or record through the Service. You grant CallMama only the limited technical rights needed to host, transmit, route, store, and deliver your communications and to run and improve the Service. We will not use the content of your calls, messages, or recordings to train AI or machine learning models without your explicit consent. We process your personal data as described in the Privacy Policy.
10. Service availability
We work to keep the Service reliable but do not guarantee it will be uninterrupted or error-free. Call and message quality depends on the internet, your device, and third-party carriers. We may modify, suspend, or discontinue parts of the Service, and will give reasonable notice of significant changes where we can.
11. Suspension and termination
You may stop using the Service and close your account at any time through your account settings. We may suspend or terminate your account if you breach these Terms or the Acceptable Use Policy, if required by law or a regulator, or to protect the Service or other users. Where the breach is fraud, illegal traffic, or a safety risk, suspension may be immediate and without prior notice.
After account closure, you have 30 days to export your data — including call history and voicemails — using the export tool in your account settings. After 30 days, your data will be deleted in line with the Privacy Policy retention schedule. If we terminate your account for breach, the export window may be shorter or not available depending on the nature of the breach. If you believe your account was suspended in error, email legal@callmama.com with "Account Appeal" in the subject.
12. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available". CallMama makes no warranties, express or implied, about the Service, including that it will be uninterrupted, error-free, or fit for any particular purpose.
To the maximum extent permitted by law, CallMama is not liable for indirect, incidental, special, exemplary, or consequential losses — including lost profits, lost data, or loss of goodwill — arising from your use of or inability to use the Service. Our total liability to you for any claim is limited to the amount you actually paid us in the three calendar months before the event giving rise to the claim.
This limitation does not apply to: (a) liability for death or personal injury caused by our negligence; (b) liability for fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded under applicable law, including your statutory rights as a consumer.
13. Indemnity
You agree to defend, indemnify, and hold harmless Callmama Limited and its officers, directors, employees, and agents from and against any claims, damages, losses, fines, penalties, and costs (including reasonable legal fees) arising from: (a) your breach of these Terms or the Acceptable Use Policy; (b) your unlawful use of the Service; (c) your call recordings and your failure to obtain required consents for recording; (d) content you transmit through the Service that infringes any third party's rights; or (e) your violation of any applicable law or regulation in connection with your use of the Service. CallMama will notify you promptly of any claim to which this section applies and will give you reasonable opportunity to participate in the defence at your cost. This obligation survives the termination or expiry of your account.
14. Governing law and disputes
These Terms are governed by the laws of Hong Kong, and disputes are subject to the courts of Hong Kong, except where the mandatory consumer law of your home country gives you the right to bring a claim locally — that right is not affected.
If we cannot resolve your complaint directly, you may refer it to an approved alternative dispute resolution (ADR) body in your country. In the UK, approved consumer ADR schemes are listed by the Chartered Trading Standards Institute at ctsi.org.uk. In EU Member States, your national consumer authority maintains a list of approved ADR bodies. Note: the EU Online Dispute Resolution platform was permanently closed on 20 July 2025 and is no longer available — contact your national ADR body directly.
15. Changes to these Terms
We may update these Terms from time to time. For material changes — any change that creates new obligations for you, introduces new fees, or materially affects your rights — we will give you at least 30 days' advance notice by email or in-app notification before the change takes effect. For minor updates like clarifications or typographical corrections, we will update the date at the top. Continued use of the Service after a non-material change takes effect constitutes acknowledgment of the update. Continued use does not constitute consent to material changes that require your explicit agreement — we will seek that separately.

17. Severability
If any part of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that part will be removed or limited to the minimum extent necessary. The rest of the Terms will continue in full force and effect.
18. Force majeure
CallMama will not be liable for any failure or delay in performing its obligations under these Terms where that failure or delay results from circumstances beyond its reasonable control. Events beyond our reasonable control include: natural disasters, floods, fires, earthquakes, pandemics or epidemics, acts of government or regulatory authority, changes in applicable law, war, terrorism, civil disorder, internet infrastructure failures, power outages, failures of third-party telecommunications carriers or networks on which the Service depends, industrial action, and any other event that could not reasonably have been anticipated or prevented.
If a force majeure event continues for more than 60 consecutive days, either party may terminate the affected subscription by giving written notice. In that case, CallMama will refund any prepaid fees for the unused portion of the affected period. This clause does not excuse payment obligations that arose before the force majeure event began.
19. Waiver
If CallMama does not enforce a right or provision in these Terms on one occasion, that does not waive our right to enforce it on another occasion. A waiver is only effective if it is given in writing by CallMama.
20. Assignment
You may not assign, transfer, or delegate your rights or obligations under these Terms to anyone else without our prior written consent. We may assign or transfer these Terms, or any of our rights under them, to an affiliate or to a successor in the event of a merger, acquisition, or sale of substantially all of our assets. We will notify you if this happens.
21. HIPAA notice
CallMama is not a HIPAA-covered entity and does not execute Business Associate Agreements (BAAs) as a standard part of its service. If you are a healthcare provider, health plan, or other covered entity that requires HIPAA-compliant communications, the standard CallMama service is not designed for that purpose. If you believe your use case requires HIPAA compliance, contact us at legal@callmama.com before transmitting any protected health information through the Service.
22. Entire agreement
These Terms, together with the Privacy Policy, the Acceptable Use Policy, the Refund and Cancellation Policy, and the Call Recording Notice, form the entire agreement between you and CallMama about the Service. They replace all previous agreements, representations, or understandings between you and CallMama about the same subject matter. In the event of any conflict between these Terms and another CallMama policy, these Terms prevail unless a policy expressly states otherwise.
