Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets the rules for using the CallMama service. It is part of our Terms of Service. Breaking this AUP can lead to suspension or termination of your account, with no refund, and to reporting where the law requires it. You are solely responsible for ensuring that your use of the Service complies with this policy, the Terms of Service, and all laws and regulations applicable to you in your jurisdiction.

Definitions

  • Robocall / robotext — a call or message made using an automatic telephone dialling system, prerecorded voice, or AI-generated voice or text, without the prior express consent required by applicable law.
  • Spam — any unsolicited commercial message sent in bulk or without the recipient's consent, in violation of applicable anti-spam or telemarketing laws.
  • Traffic pumping — artificially generating call or message volume to exploit interconnection fees or access charges, through automated systems, dialer farms, or coordinated activity.
  • AI-generated content — any voice, text, or audio produced or materially altered by artificial intelligence, including voice cloning, deepfake audio, and chatbot-generated messages.
  • Artificial traffic — calls or messages generated by automated systems, scripts, or bots rather than genuine human-initiated communication.

1. The basic rule

Use CallMama only for lawful communication. Do not use it to do anything illegal, to harm others, or to disrupt the Service or telephone networks.

The prohibited activities listed in this policy are examples, not an exhaustive list. CallMama reserves the right to act on any use of the Service that we reasonably consider to be harmful, abusive, or inconsistent with the spirit of this policy, even if it is not specifically listed below.

2. Calling and texting rules

Because CallMama gives you the ability to call and text, you must follow the laws that govern how calls and messages are made. You must not:

  • Make illegal robocalls or send illegal robotexts, or use autodialing or prerecorded messages where the law forbids it.
  • Conduct telemarketing without the consent that the law requires, or call numbers on a do-not-call list in breach of the rules.
  • Send spam, bulk unsolicited messages, or messages that break telemarketing, anti-spam, or consumer-protection laws (including, in the US, the TCPA and CAN-SPAM, and the messaging rules of mobile carriers).
  • Send messaging traffic that is not properly registered where registration is required (for example US A2P 10DLC brand and campaign registration).
  • Spoof or falsify caller ID, or evade caller-ID authentication, traceback, or robocall-mitigation measures.
  • Fail to honour opt-out requests (such as "STOP") promptly.
  • AI-generated calls — do not use AI-generated voices, synthetic audio, or AI chatbots to place calls or send messages through CallMama without clearly telling recipients they are interacting with an automated system. Impersonating a human using AI-generated voice is prohibited at all times.

3. Prohibited content and conduct

You must not use CallMama to:

  • Harass, threaten, defraud, deceive, or impersonate any person or organisation.
  • Distribute malware, run phishing or scam campaigns, or attempt to gain unauthorised access to any system or account.
  • Transmit content that is unlawful, that sexually exploits or endangers children, or that incites violence or unlawful discrimination.
  • Infringe intellectual-property rights, misappropriate others' personal data, or use personal data obtained through the Service for purposes incompatible with the purpose for which it was collected — including building profiles of individuals from call records without their knowledge or consent.
  • Use the Service to evade lawful interception, sanctions, or export controls, or to call or text destinations you are barred from contacting.
  • Synthetic and AI content — generate or transmit synthetic voice, deepfake audio, or AI-generated impersonation content through the Service, or use AI tools alongside the Service without complying with applicable AI transparency and disclosure laws.

4. Call recording — your responsibility

Call recording is only available in the CallMama web portal — the mobile app cannot record calls. If you use the recording feature, you are responsible for getting consent from everyone on the call before you start recording. This applies in every country, including the US, UK, Europe, Canada, and Australia. Recording without required consent can be a criminal offence. See the Call Recording Notice.

5. Service integrity and fair use

You must not resell the Service unless your plan permits it, share one account across many unrelated users to evade limits, place artificial or fraudulent traffic, or use the Service in a way that degrades it for others. "Unlimited" or high-allowance plans are for normal personal or business communication and not for traffic pumping, dialer farms, or machine-generated abuse. If you are a business using CallMama to build a product or service for your own customers, you are responsible for ensuring those customers comply with this policy.

  • Account transfers — do not transfer, sell, share, or give access to your CallMama account to any other person without our prior written permission. Your account is personal to you.
  • Free trial abuse — do not attempt to obtain multiple free trials, circumvent eligibility requirements, or use false information to access trial features. Each user is entitled to one trial per the terms advertised at the time.

6. Emergency services

CallMama is an internet-based app and is not a replacement for your regular phone service. Do not use CallMama to contact emergency services.

CallMama does not support emergency calling (including 911, 112, 999, or any local emergency number). We cannot connect you to emergency services, and we cannot transmit your location or callback number to an emergency operator.

Emergency calling will not work if your internet connection is down, your device is off, or your account is suspended or inactive.

By using CallMama, you acknowledge these limitations and agree to always maintain an alternative means of contacting emergency services.

7. Reporting abuse

To report abuse of the CallMama service — spam, scam calls or texts, harassment, or illegal traffic — email support@callmama.com (subject: Abuse Report). We investigate reports and act on them.

8. Enforcement

We may investigate suspected breaches and may suspend or terminate accounts, block traffic, remove content, and cooperate with carriers, regulators, and law enforcement. Where there is fraud, illegal traffic, or a safety risk, we may act immediately and without prior notice. If you believe your account was suspended in error, email legal@callmama.com with "Account Appeal" in the subject line. We aim to respond within 5 business days.

9. Changes

We may update this policy from time to time. For significant changes — like new prohibited uses or new enforcement powers — we will give you at least 30 days' notice by email or in-app notification before the change takes effect. For minor updates we will change the date at the top. Questions: legal@callmama.com.

9A. Other important terms

Governing law. This policy is governed by and interpreted in accordance with the laws of the Hong Kong Special Administrative Region, consistent with the Terms of Service. In the event of any conflict between this policy and the Terms of Service, the Terms of Service prevail.

Brand use. You may not use the CallMama name, logo, or any of our trademarks in any product, service, or marketing material without our prior written consent.

Language. This policy is written in English. If it is translated into any other language, the English version controls in the event of any inconsistency.

9B. Your liability to us

You are responsible for any loss, damage, or cost that CallMama suffers as a result of your breach of this policy or the Terms of Service.

You agree to defend, indemnify, and hold harmless Callmama Limited and its officers, directors, employees, and agents from and against any claims, damages, fines, penalties, legal costs, and other liabilities arising from:

  • your use of the Service in breach of this policy or applicable law;
  • content you transmit through the Service that infringes a third party's rights or violates applicable law;
  • your failure to obtain required consents, licences, or authorisations before using a feature of the Service; or
  • your breach of any obligation to a third party arising from your use of the Service.

This obligation to indemnify CallMama survives the termination or expiry of your account and continues for as long as any related claim or liability remains outstanding.

9C. What survives when your account closes

When your account is closed or terminated, the following parts of this policy continue to apply: the prohibited activities and content rules, the call recording obligations, the liability and indemnity section, the governing law clause, and any other provision that by its nature is intended to remain in effect after your account ends. Past conduct that breached this policy remains subject to these terms even after your account is closed.
